CANCELLATIONS AND REFUNDS

Moveable Alpha subscription service can be canceled at any time via the Account portal which is accessible in the Menu by Members. No further charges will be made upon cancellation. However, no refunds or credits will be offered for partially used subscription periods. Service will terminate at the end of the already paid-for billing cycle.

We strive to provide enough content that any would be subscribers can properly familiarize themselves with our content prior to signing up. As a digitally delivered product, allowing refunds once access to content has been granted allows for the abuse of access at little to no cost which is unfortunately common in Our industry. Similarly, we do not offer free trial periods. We thank you for understanding.

If choosing to upgrade to a higher tiered service, any already paid amounts will be prorated to the new subscription and there is no double charging.

SUCH LIMITATION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, EVEN IF MOVEABLE ALPHA, ITS INFORMATION PROVIDERS, OR ANY OTHER THIRD PARTY INVOLVED IN OR RELATED TO THE MAKING OR COMPILING OF ANY PART OF THE WEBSITE HAS BEEN ADVISED OF OR OTHERWISE MIGHT HAVE ANTICIPATED THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE WEBSITE IS TO STOP USING IT. THE SOLE AND EXCLUSIVE MAXIMUM LIABILITY TO MOVEABLE ALPHA FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE), OR OTHERWISE) SHALL NOT EXCEED THE TOTAL AMOUNT PAID TO US BY YOU, IF ANY, FOR ACCESS TO THE WEBSITE OR ANY SERVICES, DURING THE PREVIOUS SIX (6) MONTHS PRIOR TO BRINGING THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

INDEMNIFICATION

aS A condition of your use of the WEBSite, you agree to indemnify, defend and hold us, our officers, directors, employees, agents, representatives, information providers, and any other third party involved in or related to the making or compiling of the WEBSite harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (a) your violation of the TERMS OF USE; (b) your use or any third party’s use of, or inability to use, the WEBSite; (c) your violation of the rights of any third party, or (d) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these TOU and your use of the WEBSite.

TERMINATION

You understand and agree that MOVEABLE Alpha may, under certain circumstances and without prior notice to you, terminate your access to and use of the WEBSite. Cause for such termination shall include, but not be limited to, (i) breaches or violations of the TERMS OF USE or other agreements or guidelines, (ii) requests by law enforcement or other government or regulatory authorities or (iii) repeat violators of third party copyrights or other intellectual property.
